Roman Polanski's three decades as a fugitive are coming back to haunt him.Nothing his previous escape from U.S.authorities,Switzerland's top criminal court on Tuesday rejected Polanski's appeal to be released from prison because of the "high" risk that the 76-year-old director would try to flee again.Polanski's offers of bail, house arrest and electronic monitoring failed to sway the tribunal. Even a Swiss chalet in the luxury resort of Gstaad was brushed aside as insufficient collateral to guard against Polanski fleeing the country, as the United States seeks to have him extradited for having sex with a 13-year-old girl in 1977.In its verdict, the Swiss court said Polanski offered to surrender his travel documents, wear an electronic monitoring device and submit himself to daily police checks. Those measures were seen as insufficient to prevent his flight because he could always obtain a new passport or even travel to his French home without papers.
The Swiss court also was concerned that Polanski could avoid the extradition process if he fled Switzerland by helicopter or private airplane.Lawyers for Polanski offered up the director's Gstaad chalet as collateral, saying it represented more than half of his personal wealth and that it would definitely guarantee his remaining in the country because he has two children he must support through school.

The court, however, sided with Swiss authorities who said even the large bail offer provided insufficient security against flight, and should be made in cash.The Swiss Justice Ministry said it would examine any new request Polanski submits and evaluate whether it represents a "concrete, realizable" offer as the court ruling suggests.But,spokesman Folco Galli reiterated that detention is only lifted in exceptional cases.It is not clear how much time in jail Polanski faces now, either in Switzerland or in the United States. With appeals, the extradition process in Switzerland could take months. Text messages between a woman and former NFL quarterback Steve McNair made in the hours before police say she shot him to death and turned the gun on herself support authorities'contention that she was spiraling out of control.Nashville police released the 50 text messages Monday night as part of a case summary and detailed the exchanges between the two hours before the July 4 murder-suicide.Sahel Kazemi texted Steve McNair on July 3 to say Kazemi was so stressed she might have a breakdown and asked for $2,000 to pay bills.One text said she might need to go to a hospital because she could hardly breathe.Police say texts show Steve McNair had someone transfer the money.The texts also show Kazemi meeting McNair at the Nashville condominium where he was shot.Steve McNair asked her to leave the front door open for him."If anyone has information that needs to come to the attention of the police department, we'll be happy to receive it as part of this investigation," Aaron told The Associated Press. "But at this juncture, there has been nothing uncovered that suggests this is not a murder-suicide."Kazemi's texts to McNair talk of her showing furniture she planned to sell to some people and how she was at a store "trying to fix" her phone. She wanted to pay bills before going to work. When she said she could hardly breathe, McNair asked if she wanted him to come over. She said she would take a nap.McNair texted her that afternoon, saying he had someone transfer the money.The summary also details how police checked video footage from businesses in the area and found a law firm camera caught the backside of the condo where their bodies were found later July 4.The footage did not show any suspicious activity or departure in the early hours of that morning.Police also list the shift manager at the restaurant where Kazemi worked who told officers something seemed to be bothering Kazemi on July 3. Sonya New said she asked Kazemi if everything was all right when the server told her of her DUI arrest on July 2.The manager also knew of Kazemi's roommate moving and asked about McNair's divorce."And Kazemi just rolled her eyes. New said at the end of the conversation,Kazemi said,"My life is just (awful) and I should end it."Business was slow that night when Kazemi asked if she could leave early.Kazemi clocked out at 10:07 p.m.The report also includes details from the crime scene that blood stains showed Kazemi's upper body was in McNair's lap before sliding to the floor.Police also found the gun under Kazemi's head with an impression in the carpet the summary said indicates neither the gun nor Kazemi's body was moved before officers arrived.

Plum Organics of Emeryville,Calif.Plum Organicsis recalling some of its apple and carrot portable pouch baby food because of concerns over possible botulism contamination.The product was sold individually throughout the country at Toys-R-Us and Babies-R-Us stores. The recalled product is sold in 4.22-ounce pouches, with a "best by" date of May 21,2010,and UPC 890180001221.
"The product did not meet the FDA guidelines for proper acidity level,"Paul Gerhardt,a member of the Plum Organics action team, said in a statement.The company is concerned that the baby food may be contaminated with Clostridium botulinum, which can cause botulism, a serious and sometimes life-threatening condition. Consumers should not use these products, even if they appear to be normal, because of the possible health risk.No illnesses have been reported in connection with the baby food, and no other Plum Organics products are affected, the company said in a statement.

Tierney was forced to drop out of the series this summer after being diagnosed with breast cancer, for which she continues to get treatment.Originally slotted for a fall premiere, "Parenthood" is now set to debut in early 2010. Diane Sawyer to replace Charles Gibson

In a major and uxexpected move, ABC News anchor Charles Gibson announced that he will retire at the end of the year, and Diane Sawyer will become the anchor of ABC's "World News."

The 66-year-old Charles Gibson said in an email to ABC News staffers Wednesday that he had planned to retire as early as 2007, but that unexpected events in the news division resulted in him staying on. Longtime anchor Peter Jennings died in 2005, and then his replacement, Bob Woodruff, was seriously injured in Iraq in January of 2006. Charles Gibson, who has anchored ABC’s "World News" since 2006, will retire at year’s end, he told ABC News staff in an email sent this morning.


Diane Sawyer, his former “Good Morning America” co-host, will replace Gibson in January.

Charles Gibson, who is 66, says in the email that he had always intended to retire in 2007 before the “World News” job came open.

Curt Schilling, the former major league pitcher who won the allegiance of Bostonians by leading the Red Sox to the 2004 World Series, said Wednesday that he has "some interest" in running for the seat held for nearly 50 years by Democratic Sen. Edward M. Kennedy.

Schilling, a registered independent and longtime Republican supporter, wrote on his blog that while his family and video game company, 38 Studios, are high priorities, "I do have some interest in the possibility."Any other comment "would be speculation on top of speculation," Schilling said, adding, "My hope is that whatever happens, and whomever it happens to, this state makes the decision and chooses the best person — regardless of sex, race, religion or political affiliation — to help get this state back to the place it deserves to be."Schilling told New England Cable News that he has been contacted "by people whose opinion I give credence to," but he did not elaborate. Coroner rules Michel Jackson's death homicide


The Los Angeles County coroner's finding that the death of Michael Jackson was a homicide could mean criminal charges for his doctor, who told investigators that he administered a mix of powerful drugs to treat the pop star's insomnia hours before his death.The homicide ruling was based on forensic tests that found the anesthetic propofol combined with at least two sedatives to kill Jackson, a law enforcement official told The Associated Press on Monday, speaking on condition of anonymity because the findings have not been publicly released.Las Vegas cardiologist who was caring for Jackson when he died June 25 in a rented Los Angeles mansion.Through his lawyer, Murray has said he administered nothing that "should have" killed Jackson.Murray said he feared Jackson was becoming addicted to the anesthetic, which is supposed to be used only in hospitals and other advanced medical settings.

Murray told detectives that he had lowered the propofol dose to 25 milligrams and added the sedatives lorazepam and midazolam two days prior to Jackson's death, a combination that succeeded in helping the pop star sleep. The next day, Murray said, he cut off the propofol — and Jackson fell asleep with just the two sedatives.

But on June 25, Murray said he tried unsuccessfully to make Jackson sleep with a series of drugs that included a 10-milligram tablet of Valium and repeated injections of two milligrams of lorazepam and two milligrams of midazolam.

Murray told investigators he didn't order or buy any propofol, but investigators served a search warrant Aug. 11 at a Las Vegas pharmacy and uncovered evidence showing Murray legally purchased from the store the propofol he gave Jackson on the day he died.

Jackson's family released a statement Monday, saying it has "full confidence" in the legal process and the efforts of investigators. It concludes: "The family looks forward to the day that justice can be served."
